Selected highlights

Filed complaint in CO District Court against client’s landlord and property management company for violations of Colorado’s warranty of habitability, wrongful withholding of security deposit and unjust enrichment.  Favorably settled for treble damages.

Represented client in CO District Court for breach of contract, suit on account, unjust enrichment, to foreclose mechanics lien and for damages for client with respect to residential construction project; received favorable settlement.

Representing Plaintiff in US District Court, District of Colorado, in 1st party common and and statutory bad-faith claims, including breach of contract against automobile insurer related to traumatic brain injury (TBI)

Filed successful declaratory judgment action in US District Court, District of Colorado, holding deed restriction clauses were unreasonable restraints on alienation and void ab initio as a matter of law; upheld on appeal to 10th Circuit Court of Appeals.

Filed complaint against client’s HOA, contractor, and property management company for negligence, violations of Colorado’s Common Interest Ownership Act, breach of contract, breach of implied warranty, breach of fiduciary duty and duties of good faith; settled prior to trial.

Led and managed a $60M American Arbitration Association (AAA) intellectual property arbitration under procedures for Large, Complex Commercial Disputes, regarding definition of bundled licensed product IP dispute.

Successfully defended multi-million breach of contract matter for large NM ranch owner in US District Court, District of New Mexico.

Represented client in CO District Court on behalf of clients against roofing contractor and its insurance company for breach of contract, and negligence; disposition pending.
